Both statutes aim to strengthen public-sector integrity, yet rigid statutory rules and gaps in implementation have generated unintended effects.First, the single monetary threshold for bribery sanctions under the Improper Solicitation and Graft Act disregards occupational relevance, undermining proportionality and fairness in criminal enforcement. To address this, the study proposes a graduated penalty scheme calibrated to the degree of duty-relatedness, supplemented by a weighted formula to ensure rational and consistent sanctions.Second, the statutory ceiling on honoraria for outside lectures has remained unchanged since 2018, resulting in an estimated 17% decline in its real value and discouraging expert engagement. A CPI-linked automatic adjustment mechanism and unified standards across occupational groups are recommended to restore the system%u2019s effectiveness and maintain fairness.Third, the Conflict of Interest Prevention Act defines pre-employment ties within two years as permanent conflicts, failing to consider the natural attenuation of such ties over time and thereby functioning as an excessive regulation.
